Information regarding Implied Warranty, Product Guarantee and Warranty

1. Implied Warranty

When are you eligible for submitting a claim for implied warranty?
According to the Civil Code of United Kingdom, you may submit a case for implied warranty against LED Leet Ltd. in the case of defective performance.

What rights are you eligible for in the case of implied warranty?
You may choose from the following cases of  implied warranty:
You may ask for a repair or replacement unless your choice is unfeasable or it would mean disproportionate extra costs for the company. If you did not ask for or could not have asked for a repair or replacement, you may ask for a proportionate value consideration. You may also ask the company or another party to fix the defect. You may also withdraw from the contract.
You may also change from one case of implied warranty to another, however, you have to cover the costs of switching unless the change was necessary or it was due to the company.
What is the deadline for submitting a case for implied warranty?
You are obliged to report any defects as soon as possible but no later than two months after noticing the defect. However, we must note that you cannot submit a case for implied warranty after two years of the fulfillment of the contract.

To whom can you submit a case for implied warranty?
You may submit cases of implied warranty to LED Leet Ltd.

What other conditions apply for submitting a case of implied warranty?
If you verify that LED LEET Ltd. provided the goods and/or services, there are no other conditions to submit a case of implied warranty apart from filing a claim within 6 months after delivery. After 6 months of delivery, you are obliged to provide proof that the observed defects were present at the time of delivery.

2. Warranty

When are you eligible for submitting a warranty claim?
In the case of defective goods you may choose to exercise your right detailed in point 1 or you may submit a warranty claim.

What rights are you eligible for in the case of a warranty claim?
You may only ask for the repair or a replacement of the defective good in the case of warranty claims.

When are the goods considered as defective products?
The product is defective if it does not meet the legally effective qualitative requirements at the time of its commercial release or if it does not have the properties stated on its manufacturer’s product description.

What is the deadline for submitting a warranty claim?
You may submit a warranty claim for a product for two years after its commercial release. After this deadline, you are not eligible to submit such claims.

To whom can you submit a warranty claim and what other conditions apply?
You may only submit a warranty claim against the manufacturer and the distributor of the product. In the case of warranty claims, you are obliged to provide proof of the defective product.

In what cases is the manufacturer (distributor) relieved from its warranty responsiblities?
The manufacturer (distributor) is relieved from its warranty responsibilities only if it can prove that:
- the product was manufactured or commercially released outside of its business activities, or
- the defect of the product was not recognizable by the state of technology at the time of the product’s commercial release, or
- the defect of the product was due to the use of compulsory authority regulations.
The manufacturer (distributor) only needs to show proof to one of the above conditions in order to be relieved from its warranty responsibilities.
We must note that for the same product defect, you may not file both an implied warranty and a warranty claim. However, you may submit an implied warranty claim to the manufacturer for the repaired or replaced product after the warranty claim was successfully verified.

3. Product Guarantee

When are you eligible for the product guarantee?
LED Leet Ltd. is liable to provide product guarantee to the customer in the case of defective performance according to point 9 of the General Terms and Conditions.

What rights are you eligible for within the product guarantee and what are the deadlines associated with product guarantee?
In the event of a consumer agreement, the service provider ensures one year of product guarantee for new products in compliance with the Civil Code of United Kingdom. If the manufacturer provides better product guarantee conditions than stated in the Civil Code of United Kingdom, then the service provider also must provide the manufacturer’s product guarantee conditions to the customer. The product guarantee starts with the delivery of the goods.
The product guarantee is valid until the product guarantee deadline. If the party liable to provide the product guarantee fails to comply with this responsibility within the  deadline, the deadline is extended for 3 months for the court procedures. Failure to meet this deadline results in a forfeiture of legal rights.
In other points of the product guarantee, the conditions of implied warranty are applicable. (Point 1)

In what cases is the company relieved from its product guarantee responsibilities?
The company is relieved from its product guarantee responsibility only if it proves that the defect occured after the delivery.
We must note that for the same product defect, you may not file an implied warraty claim and a product guarantee claim, or a warranty claim and a product guarantee claim. However, you are still entitled to the right listed in points 1 and 2.
We also inform you that submitting a warranty or product guarantee claim does not qualify as a formal complaint according to the consumer protection act.
LED Leet Ltd.. will make a decision after investigating the product and the circumstances of the case. If you do not agree with the decision made, you may continue with the proceedings at the local Chamber of Commerce and Industry. WARRANTY CLAIM
